1. Introduction

1.1 Who we are

Mealody is a household meal-planning service provided by MEALODY APP SRL ("Mealody", "we", "us" or "our"), a company incorporated in Romania:

1.2 Agreement to these Terms

These Terms and Conditions ("Terms") govern your access to and use of the Mealody website and application (together, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Service.

1.3 The Service is currently free

Mealody is currently offered free of charge. We may introduce paid plans in the future; if and when we do, we will publish payment terms and update these Terms before any charges apply. See section 8.

2. Eligibility and your account

2.1 You must be 18+

You must be at least 18 years old to create and hold a Mealody account. The Service is intended for adults who plan meals for their household.

2.2 Account holder responsibility for household and children's data

As the account holder, you may add household members and enter information about them — including dietary preferences, allergens, medical or dietary notes, and the ages of children in your household — solely to generate meal plans. You are responsible for that information, and you confirm that, where it concerns another person (including a child), you are authorised to provide it. Where it concerns a child, you confirm you are the child's parent or legal guardian or are otherwise authorised. Children do not use the Service directly.

2.3 Your account

You must provide accurate information when you register (authentication is handled by our provider, Clerk) and keep it up to date. You are responsible for keeping your sign-in credentials confidential and for activity that occurs under your account. Notify us at support@mealody.app immediately if you suspect any unauthorised use of your account.

2.4 Deleting your account

You may delete your account at any time, directly in the app from your account settings, or by contacting us at legal@mealody.app. Deleting your account removes your households, members, meal plans, grocery lists, notifications and settings, as described in our Privacy Policy.

2.5 Changes to the Service

We work continuously to improve the Service and may add, change, suspend or discontinue features at any time. We will try to give reasonable notice of significant changes where we can.

3. Health, nutrition and dietary disclaimer

This section is important. Please read it carefully.

3.1 Mealody is a convenience tool, not medical or nutritional advice

Mealody is a meal-planning convenience tool. The meal plans, recipes, grocery lists, nutritional figures and other content provided through the Service are for general informational and organisational purposes only. They do not constitute medical, nutritional, dietary-medical or other professional advice, diagnosis or treatment, and must not be relied upon as a substitute for advice from a qualified professional.

3.2 Allergen and medical information is user-managed and must be independently verified

Any allergens, intolerances, medical notes or other health-related information used by the Service are the information you provide. We do not verify this information, and we do not verify the ingredients, suitability or safety of any meal, recipe or product against it. Meal plans are generated automatically (including by AI) and may contain errors, omissions or inaccuracies. You must independently check the ingredients and labels of all foods and confirm their suitability — especially regarding allergens — before purchasing, preparing or consuming anything. Do not rely on Mealody to keep you or any household member safe from an allergen or to meet a medical dietary requirement.

3.3 Consult a professional; not for serious conditions

Before making significant dietary changes, and before relying on the Service if you or a household member has a food allergy, intolerance, medical condition, is pregnant, or is otherwise vulnerable, consult a doctor, registered dietitian or other qualified healthcare professional. Mealody is not designed or intended for managing serious medical conditions or severe allergies, and must not be used for that purpose.

3.4 Nutritional information is approximate

Any nutritional, calorie or macro figures shown are estimates, may be generated automatically, and may be inaccurate or incomplete. They are provided for general guidance only.

3.5 Your responsibility

You use the Service, and any meal plan it produces, at your own discretion and risk, having read this disclaimer. To the extent permitted by law, we are not responsible for any consequences arising from your reliance on the content of the Service, subject to section 10 (which preserves your mandatory rights).

4. Acceptable use

When using the Service, you agree not to:

use it for any unlawful, harmful or fraudulent purpose, or in breach of these Terms;
attempt to gain unauthorised access to the Service, other users' accounts, or our systems;
interfere with, disrupt, overload or impair the Service or the infrastructure it runs on;
copy, scrape, reverse-engineer, resell or commercially exploit the Service or its content except as expressly permitted;
upload content that infringes the rights of others or that is unlawful.

We may suspend or terminate access to the Service if you materially or repeatedly breach these Terms, if required by law, or to protect the Service or other users.

5. Intellectual property and your content

5.1 Our content

The Service and all content we provide — including software, design, text, branding, the "Mealody" name and logo, recipe templates and other materials ("Mealody Content") — belong to MEALODY APP SRL or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service and Mealody Content for your own personal, non-commercial household use, subject to these Terms.

5.2 Your content

You keep ownership of the information and inputs you provide (such as your household and member details). You grant us a licence to host, process and use that information only as needed to operate and improve the Service and as described in our Privacy Policy. You are responsible for ensuring you have the right to provide any information about other people.

6. Third-party services

The Service relies on third-party providers (including Clerk, Supabase, OpenAI, PostHog, Sentry, Resend and Vercel — see our Privacy Policy). We are not responsible for third-party products or services, and your use of any third-party service may be subject to that third party's own terms and policies.

7. Availability

We aim to keep the Service available and working, but we provide it on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that any result or content will meet your requirements.

8. Paid services (future)

The Service is currently free. We may later offer paid plans with additional features. If we do, we will present clear payment, billing, renewal and cancellation terms at that time, obtain any required consents, and update these Terms before any payment processing begins. Until then, no payment information is collected or processed.

9. Disclaimer of warranties

To the fullest extent permitted by applicable law, and without limiting the mandatory rights described in section 10, the Service and all content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including as to accuracy, completeness, reliability, fitness for a particular purpose or non-infringement.

10. Limitation of liability and your consumer rights

To the fullest extent permitted by applicable law, MEALODY APP SRL will not be liable for any indirect, incidental, special or consequential loss, or for loss of data, arising out of or in connection with your use of (or inability to use) the Service.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law. In particular, nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or any of your mandatory rights as a consumer under Romanian and EU consumer-protection law (including Government Emergency Ordinance no. 34/2014 and related legislation). As a consumer, you benefit from those mandatory protections, and these Terms do not affect them.

11. Indemnity

To the extent permitted by law, you agree to be responsible for losses we reasonably incur arising from your breach of these Terms, your misuse of the Service, or your infringement of the rights of any other person — save where caused by our own fault.

12. Changes to these Terms

We may update these Terms from time to time — for example, when we add features or introduce paid plans. When we make material changes, we will update the "Effective date" above and take reasonable steps to notify you (for example, by email or an in-app notice). Changes will not apply retroactively. Your continued use of the Service after changes take effect means you accept the updated Terms; if you do not agree, you should stop using the Service and may delete your account.

13. Governing law and jurisdiction

These Terms are governed by Romanian law. Subject to any mandatory consumer-protection rules that grant you the right to bring proceedings in the courts of your place of residence, any dispute arising out of or in connection with these Terms or the Service will be subject to the jurisdiction of the competent courts of Brașov, Romania.

Consumer dispute resolution

If you are a consumer and we cannot resolve a complaint between us, you may turn to the National Authority for Consumer Protection (ANPC) in Romania (www.anpc.ro) and the European Commission's Online Dispute Resolution (ODR) platform (https://ec.europa.eu/consumers/odr). We are not obliged to, and do not currently, participate in any other alternative dispute-resolution scheme.

14. General

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
Severability. If any provision is found invalid or unenforceable, the rest remain in full effect.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not transfer your rights or obligations under these Terms without our consent. We may transfer ours in connection with a reorganisation, merger or sale of our business, provided your rights are not reduced.
Notices. We may give you notice by email or through the Service.
